Abstract

On October 26, 2011, Mbendo Emmanuel and Messiem Eddy killed one elephant at Ignoli village. Once informed of the situation Engogna Philippe joined them and they cut the animal into pieces, removed the tusks and put them in a bag with two weapons – one caliber 12 and one rifle to be transported to the village. 100m to the village they were caught red handed during a patrol.

Messiem Eddy was sentenced to thirty six months imprisonment, XAF 3,600,000 (three million six hundred thousand) as fines and XAF 300,000 (three hundred thousand) as court fees; Engogna Philippe, Mbendo Emmanuel were sentenced to twelve months imprisonment, XAF 1,200,000 (one million two hundred thousands) as fines and XAF 150,000 (one hundred and fifty thousand) as court fees each; Engogna Philippe, Mbendo Emmanuel and Messiem Eddy were sentenced to pay jointly XAF 1,000,000 (one million) as damages. The execution of the imprisonment term of Engogna and Mbendo was suspended; The imprisonment in default of payment was fixed to fifteen days for the recovery of court fees, one month for the recovery of fines and three months for damages.
