Abstract

Dissaka Samuel was already prosecuted for similar facts. For four years he was regularly practising big hunting in the forest using the war weapon type PMAK of one known as Samba Cyriaque. He left Ouesso on a boat with Bakoundou Gboto, Romain, José and arrived at Ngbakendze village a fishers’ camp at Sangha upstream where they walked on foot between the border of Kabo Pokola and then arrived at Lake Dzaka. While there, they killed eight elephants with a PMAK and a 10.75 rifle. Back in Pokola with the tusks and together with Bakoundou they asked the help of Ekenga Abraham to bring them to Ouesso to sell the ivory . Ekenga tied the tusks inside a mattress and they went to Ouesso. Three kms from Pokola they were caught and arrested by rangers, brought before the state prosecutor and sent to court for trial.

Dissaka Samuel was sentenced to five years imprisonment, XAF 1,000,000 (one million) as fines each and to pay XAF 2,000,000 (two million) as damages and court fees. The imprisonment in default of payment was fixed to its maximum.
