Abstract

Ndombi Antoine is living at Ngagadza camp and is owner of two firearm type caliber 12 Baïkane and caliber 375. In April 2016, he is contacted by his grandson who wanted the weapons to carry out big hunting. Ndombi Antoine gave the weapons to his grandson named Odziki Rodrigue who partnered with Okombi and Ollombo. While Odziki and his two partners were in the forest, Odziki shot and killed one elephant. Then Ollombo inadvertently shot three caliber 12 bullets on Odziki and seriously wounded him. Odziki is transported to the CIB clinic where he denounced the facts while the others ran away. It’s in these conditions that Ndombi Antoine was brought before the state prosecutor and charged of complicity of killing a totally protected specie.

Ndombi Antoine was sentenced to twenty four months imprisonment, XAF 100,000 (one hundred thousand) as fines, and to pay XAF 500,000 (five hundred thousand) as damages and court fees. The imprisonment in default of payment was fixed to its minimum.
