Abstract

In April 2019, Ebisse Jean Claude was going to Ouesso together with Nguie-Ngola Habib who was in possession of a PMAK war weapon that came from Brazzaville. Once at Sembe, they were joined by Bibiong Brunel for an elephant hunting expedition during which they killed one elephant with tusks weighing 15kg that they sold for XAF 150,000 (one hundred and fifty thousand). Back in Ouesso, Ebisse Jean Claude organized another poaching expedition led this time by Mengbalebou Adi together with Nguie-Ngola Habib and Akale who killed one elephant which ivory weighted 04 kg that they sold for XAF 16,000 (sixteen thousand) at Cabosse.

Ebisse Jean Claude, Nguie-Ngola Habib, Bibiong Brunel were condamned to two years imprisonment term and XAF 1,000,000 (one million) as fines. Ebisse Jean Claude, Nguie-Ngola Habib, Bibiong Brunel were ordered to jointly pay the sum of XAF 3,000,000 (three million) as damages and to pay the costs. The duration of the imprisonment in default of payment was set to the minimum. The accused were sentenced to several offences; however, since according to the Congolese law the cumulation of penalties is not allowed they were sentenced to the most severe penalty.
