On 25th day of 2013, accused was found in possession of the Government trophy and was charged for being in possession of the Government trophies contrary to section 86 (1) and (2) (b) of the Wildlife Conservation Act, No. 5 of 2009 read together with section 14(d) of the Economic and Organized Crime Control Act [Cap 200 R.E 2002].
The accused persons were charged jointly and severally for contravening various provisions of the laws governing and regulating possession and disposition of the Government trophies. The main charge around this case was unlawful exportation of wild animals with total value of Tshs. 170,575,500.
Accused person were arrested for having been found in possession of a government trophy and were charged accordingly. There pleaded guilty and were convicted.
On 25th August, 2013 at about 01:00hrs at Mheza-Maore Village within Same District – Kilimanjaro region, the appellant was arrested for being in unlawful possession of the government trophy which is one “cheeter” skin worth Tshs. 7,942,900, the property of the government of the United Republic of Tanzania and without permit or license.
On 13th December, 2012 at Kishisha Village, Siha District at Kilimanjaro region, the accused was arrested by the Kinapa Park rangers on allegations of possessing government trophy which was hyrax. This was contrary to the Wildlife Conservation Act, No. 05 of 2009. He was charged for the first time at Hai District Court on 24th January, 2013.
From July to August 2017, Jianhuo C. hired Jianfa C to process and polish a batch of ivory beads at a price of 0.5 yuan each; from July to August 2018, Jianhuo C. handed over two bags of ivory beads to Jianfa C. for processing and polishing. After identification, the net weight of ivory products was 0.733kg, valued at 21541 yuan.
From May to June 2018, Meifang W. illegally purchased wild herons (dead bodies) from Sun (separate case) for prices ranging from 20 yuan to 35 yuan, and the birds were used in restaurants to process into dishes for customers. Meifang W. paid a total of 4,485 yuan for the purchase of wild birds to Sun. Meifang W.
On December 2, 2013, Min G., Zhiqiang X. and Linzheng G. sold a rhino horn product to Meiyang L.. After identification, the rhino horn had a net weight of 4.942 kg and a value of RMB 1.231 million. On December 17, 2018, the Xianyou County Public Security Bureau seized 16 suspected ivory beads at Min G.'s rental house.
From April to July 2018, Qiuhe P. illegally purchased wild heron birds at a price ranging from 27 yuan to 45 yuan from Sun (sentenced) and others, and the birds were used in restaurants to process into dishes for customers. Qiuhe P. paid 5,309 yuan for the purchase of wild birds (dead bodies) to Sun through Wechat transfer. Qiuhe P.
On May 28, 2017, Shengli L. had planned in advance and hired Tuoyong W. to drive to the dock near Hanhai Shipyard in Lianjiang County to receive a batch of live birds.
