Abstract

In March 2016, the accused persons were found in the Forest of Malabo, in PK 45 with a war arm, 01 Kalashnikov and 12 ammunitions hidden in a tree trunk. The arm belonged to the accused DIOP Therno, and it was used by the co-offenders NGOMNA Sylvestre, BAGOUNA Florient and KONGA Eric to carry out large-scale hunting under instructions of DIOP Therno. They all pleaded guilty as charged. Following interrogations and establishment of their offence reports, they were forwarded together with the seized items as exhibits before the State Attorney of the Military Court, Bertoua for prosecution.

NGOMNA Sylvestre and BAGOUNA Florient were found guilty of illegal detention of a war arm & ammunitions, not guilty of poaching, and were sentenced to fifteen (15) months fixed imprisonment term each and to pay 40.125XAF for costs of the proceedings. While DIOP Therno and KONGA Eric were found guilty of all counts, were sentenced to three (3) years imprisonment term each, and to pay 107.250 XAF as for costs of the proceedings.
