Abstract

The accused was arrested by elements of the forestry and wildlife control post in a vehicle. He was the driver of the said vehicle. The elements proceeded to search the vehicle while searching the vehicle he behaved suspicious. Based on this the elements proceeded to search goods. A parcel was uncovered containing 16 Ivory tusks. The accused claimed it belonged to a passenger he transported. The matter was forwarded before the Court of First Instance, Bertoua for prosecution on the illegal trafficking of trophies of totally protected animal species. In the ruling by the said court, he was found not guilty of all counts and was discharged and acquitted. The legal department and the civil party, the Ministry of Forestry and Wildlife took an appeal to review both the penitentiary and pecuniary sentence of the accused.
