Abstract

In the second half of 2012, the defendant Linlong X. purchased multiple geese from others, and later sold 4 of them to the defendant Wang, and Wang sold them to Du, the owner of the Gangxi Guest House. Afterwards, the public security organ detained 3 wild geese in the Gangxi Guest House and 1 wild geese in Linlong X.'s home. From October to November 2012, the defendants Fanfeng Y., Yunjie S., Yehao D. and Dong(separate case), after premeditated, took the method of putting “Kebowei” pesticide in the Beidagang Reservoir and poisoned wild ducks three times with a total of more than 30 birds. They sold them to Wang, and received more than 2,800 yuan.

Du was sentenced to 2 years in prison, 2 years’ probition and a fine of RMB 5,000. Fanfeng Y., Yunjie S., Yehao D. were sentenced to a fine of RMB 2,000, respectively. The appellate court upheld this decision. All crime involved items confiscated.
