Abstract

A semi-nomad called EGBOGBO offered OLALA Willy two ivory tusks. OLALA WIlly informed ABDOULAYE MAHAMAT, who is a buyer of this type of trophy. ABDOULAYE MAHAMAT came to collect the tusks and was accompanied by HASSAN Ismael. After picking up the tusks, they cut them in half and thus had 4 pieces. Willy OLALA was given a cash advance of 260,000 XAF (two hundred and sixty thousand) out of a total of 360,000 XAF (three hundred and sixty thousand). The trophies were transported by two natives of the area to the house of Sieur MOSSOBO Sedel, who was to hand over the trophies to KEMA John Médard to take them to Pokola, where ABDOULAYE MAHAMAT was waiting for him to send the ivory pieces to Douala in Cameroon. OSSOBO Sedel had retained the fourth piece until he was paid by ABDOULAYE MAHAMAT, but was arrested by the eco-gardes of the PROGEPP Kabo. The other members of the group were subsequently arrested.

The accused were sentenced to 18 months firm imprisonment and a firm fine of XAF 1,000,000 ( one million). They were ordered to pay the sum of XAF 1000,000 (one million) in solidarity as damages and interests. They were ordered to pay costs set at the sum of XAF 1500,000 (one million five hundred thousand ) at a rate of XAF 300,000 ( three hundred thousand) each. The duration of the imprisonment in default of payment was set at 15 (fiftheen) days for the recovery of court costs, 1 (one) month for the recovery of fines and 3 (three) months for the recovery of civil damages.
