Abstract

On the 20 August 2013, a certain MESSI Mvondo, a warrant officer took the accused SODJA Lucien, a senior warrant officer and NDONGO Leonard for poaching in a Forest Management Unit called FMU-LOREMA, a protected area. While in the forest, they all went their separate ways while Ndongo Leonard was in charge of catering. The parties agreed to end the poaching on the 20 August 2013 and return to town. On this date, Messi Mvondo did not show up. Both Sodja and Ndongo looked for him the whole day in vain. On the 26 August 2013, he was found dead and his body in an advanced state of decomposition. During interrogations, both Sodja and Ndongo pleaded not guilty. They both claimed they went into the forest to look for gold and not carry out poaching that was why they had no arms nor any trophies of protected species at the time of arrest. At the close of interrogations, they were all transmitted to the State Attorney for prosecution.
