The court held that there was nothing which linked the tank that contained the rhinoceros horns especially with the appellant, therefore the magistrate had been misdirected. The court accepted that the evidence in this matter indicated that the appellant had driven past the road block and that he had guilty knowledge that he had carried illegal trophy. The court held that the appellant was guilty of joint possession of the trophy. The court dismissed the appeal.
