Roy Hendricks brought a Bivens action against Walter Saroka and Jerry Woods, Special Agents for the United States Fish and Wildlife Service, alleging violation of rights securied under the Fourth Amendment. The district court granted summary judgement in favor of Saroka and Woods, and Hendricks appeals (current case).

The king crab at issue was caught within the Russian Exclusive Economic Zone ("EEZ") by two Russian vessels, the F/V Deep Sea Harvester and the F/V Lucky Star.

The accused and three other men were inside the Ndumo Game Reserve on 19 November 2011 at 17:00. One man was carrying a firearm. Game rangers patrolling in the Reserve caught sight of the men in pursuit of a rhino. The rangers ordered the man to put down the firearm. Instead, he turned and pointed it at the rangers.
