On December 4, 2018, the defendant Ping L. invited the defendants Guiping C., Shaokun Y. and Yunhong L. (handled separately) to hunt wildlife. At about 20 o'clock on the same day, Ping L. drove the other three to the mountain forest in Chuyang Town, Wushan County, Chongqing City.
In November 2010, Xianjin G. purchased a black bear under second class state protection from Lu and Hu at a price of 4,400 yuan. Later, Xianjin G. sold the black bear to Li and Song. On January 22, 2013, Xianjin G. purchased a wild goat from Pan at a price of 800 yuan. The wild goat was found and seized from Xianjin G.'s house.
The appellants appealed their convictions to the Supreme Court. The grounds for the appeal were that the admissions made to Mr Kao of the Ministry of Wildlife and Conservation were inadmissible for not being made freely and voluntarily, with which the High Court agreed.
The accused, in this automatic review matter, was tried in the Grootfontein Magistrate’s Court, on one count of hunting specially protected game, (namely: a giraffe, valued at N$9000-00) in contravention of section 26(1) of Ordinance 40 of 1975. He was convicted as charged and sentenced to five years direct imprisonment.
The appellant was convicted by the magistrate court with four men of illegal hunting and killing of a conserved animal, giraffe (without a license or permit) contrary to the Fauna Conservation Proclamation. The appellant himself did not kill the animal but instructed the other four men to kill the animal.
At 11:00 on January 15, 2019, the defendants Zhongmin W., Yinbu Z., Yonghua G and Changsheng F. met together, each carrying a slingshot and other tools to hunt birds in the Nanbai forest in Jinggou Village, Zhen County, Lingbao City. They conducted hunting separately and handed over the pheasants to Changsheng F. Among them, Zhongmin W.
At the beginning of April 2015, the defendant Zaigang W. purchased a total of five golden pheasants from Mucheng L three times and one golden pheasant from Xiao. On the same month, on the 12th, he purchased one golden pheasant from He and Zhang, respectively. On the 19th, he purchased a golden pheasant from He and Zhang Moujia, respectively.
