An appeal against the judgement of a Magistrate Court against the accused for excessive conviction for unlawful hunting of rhinos and insufficient evidence to sustain conviction. The appeal was dismissed as lacking merit and the decision of the Magistrate Court affirmed.
This a criminal appeal against the decision of the magistrate court in terms of which the appellant was convicted of contravening s 17(2) of the Wildlife Conservation and National Parks Act 1992 (No. 28 of 1992) and was sentenced to 8 years imprisonment.
The Accused was arrested at Kaburara in Kasese District and taken to Kasese police and was later transferred to Kampala CPS.
In July 2015, the defendants illegally entered the NOUABELE – NDOKI National Park, where, they killed a long nose crocodile, a fully protected animal. They were then pursued by agents of the park, arrested and brought to the State prosecutor.
On the 22nd day of March 2018, the police got information that there were wildlife species which were being traded at Katwe Kabatoro. The sellers of these species were camped in a bar called Tereseke. The accused was arrested and his co accused took off. The police recovered big skins of crocodiles and teeth of hippopotamus.
