This is a criminal case in which a tremendous effort to smuggle psittacine (parrot) birds into the United States from the Republic of Mexico was exposed. There is a quarantine against the importation of such species into the United States. The indictment was in ten counts. Three separate conspiracies were charged (Counts 1, 4, and 7).
The appellant pleaded guilty to dealing with goods with intent to evade the prohibition or restriction on their exportation, contrary to the Customs and Excise Management Act 1979.The appellant was involved in carrying eggs of peregrine falcons with intent to evade the prohibition on their exportation.
On July 17, 2015, Mbo Mwampongo, Ayembe Gérald and Botamba Ekoto went to Djaka forest where they captured ninety parrots using glue-coated wooden twigs put on trees. Caught by rangers they were brought before the state prosecutor.
Since October 2012, Xiao Wenwu has deposited the owl he acquired in an unlicensed bungalow in the Yanghe Village Farm, Guangzhou, which he leased from Gao, and hired Gao ’s worker Liao Congyun Help him feed and feed the owl part-time, and hire the same person Huang Jie to help him deliver the owl.
In January 2017, Bendo-Moukouli Eddy contacted one known as Destin for illicit capture of parrots and gave him the sum of XAF 450,000 (four hundred and fifty thousand) to get all the necessary materials for the operation. Destin then captured illegally 141 (one hundred and forty one) heads of parrots.
In June 2015, Ngo Sylvestre a Cameroonian entered into Congo and settled at the village Bolozo, Ngbala district where he benefitted from the complicity of Bouba Bonaventure a native from this village to capture an important quantity of parrots. They arrested and brought to the state prosecutor then sent to court for trial.
In December 2016, Lessia Punda Tudi and Ngai Mathurin resident in Ouesso at Mindongo area decided to organize an operation to capture parrots in the Nouabale Ndoki national park, an area forbidden for hunting. During ranger patrols they were arrested and brought to the state prosecutor and then sent to court for trial.
On January 20, 2016, Niama Pololo Elie left Ngombe to Mbirou to capture parrots. While there, he managed to capture 58 (fifty eight) parrots before been caught by rangers.
In November 2011, Yangole Georges killed 290 (two hundred and ninety) parrots in a Kabon during a period closed for hunting.
