The appellant is appealing against the decision of the high court which upheld the decision of the Resident Magistrate Court on the ground that the consent of the Director of Public Prosecutions was not granted in terms of section 26(1) of the Economic and Organized Crime Control Act (CAP 200 R.E.
Sometimes on 02nd December, 2015 at Gua village within Chunya District in Mbeya region accused person was arraigned and found in unlawful possession of government trophy. Also was in unlawful possession of muzzle loading gun. Then brought before the court to answer a charge. The accused was convicted.
The accused persons were arrested at Kasumulu while crossing the border from Malawi to Tanzania. During their arrest they were found with unlawful possession of government trophy namely two rhino horns contrary to the penal laws of Tanzania. Thereafter were prosecuted before Kyela District Court.
Sometime on 25th March, 2015 at Gua village within Chunya District in Mbeya region was found in unlawful possession of the government trophies. Also was found in unlawful possession of firearms. Then brought before the court to answer the charge. The accused was convited.
Sometimes on 21st November, 2015 at Gua village within Chunya District in Mbeya Region accused person was found in unlawful possession of government trophies property of United Republic of Tanzania, and unlawful possession of firearm. Then brought before the court to answer a charge. The accused was found guilty and convicted.
On the 11th day of march 2015, during the city search, the house of the accused was searched. He was found in possession of one piece of Dik-dik horn and one piece of lizard skin. The case was dismissed under section 225(5) of the Criminal Procedure Act.
On the 11th day of march 2015, at around 07.45 hours during city search in Mwanza, the accused was arrested for practicing as a traditional healer without being registered. She was further found in possession of 4 wildebeest tails, 1 piece of grey headed king fisher, two pieces of lion’s skin and one piece of duiker skin.
On the 11th day of March, 2015 the accused was found in possession of one piece of the African hare skin. The accused was also found practicing traditional healing without being registered. The Court dismissed the appeal under section 225(5) of the Criminal Procedure Act.
On the material date, at 22.00 hrs at Tingirima village within Bunda District in Mara Region, the accused was found in the possession of skins of dik-dik, two pieces of dried meat of the wildebeest and a piece of elephant tusk, after an emergence search in his house, a house owned by his mother and elder brother while he was sleeping.
