The accused NKOETYE ESSIANE, a pastor resident at OVENG challenged the court judgement no.135/COR of 12 June 2001 in which the Court of First Instance Djoum in its judgement by default found him guilty of killing a protected animal species and sentenced him to one year fixed term imprisonment, to pay 1,000,000 XAF for fines, 230,000 XAF for civil damages and issued an arrest warrant against him. During the date of the retrial, the accused solicited bail which was denied by the court on the grounds that his detention was still necessary for the preservation of Justice. The accused brought up the request for bail again during the proceeding trial and based his argument on the grounds that he has huge family and professional obligations and provided the court with his new address. He further provided the court with his serious surety and the court further found that his detention was no longer necessary for the preservation of Justice. On these grounds the court granted him bail and adjourned the matter for hearing.
