The accused FOTSA Olivier Colince was summoned before the Court of First Instance, Djoum to answer charges of illegal detention of firearm and ammunitions; detention and circulation of trophies of class A totally protected animal species; and complicity to hunting without permit or license. During the court hearing of 28 November 2017, the accused FOTSA Olivier Colince presented his application for bail. Supporting his application, he stated that he is married and a father of a very large family in which he is the sole bread winner. Also, he is the owner of a sewing workshop which, because of his incarceration, is being vandalized by unknown persons. More so he presented as guarantor of his representation in court appointments SUKAM CHOUDJA Guy Alain, a mechanic residence in Djoum. The state Attorney opposed the accused’s application for bail. However, considering that bail is the principle and detention the exception, the court resorted to examine Article 218 of the Criminal Procedure Code which provides the conditions under which a remand in custody may be issued against a defendant. On regarding these conditions, the court found that not only is it no longer necessary to detain the accused on basis of establishing the truth, but he presented a surety who undertook to produce the accused any time as requested by the court. He was granted bail and the matter adjourned to continue hearing.
