Abstract

On the 14 June 1993, the accused ONVA ELLA Emmanuel was summoned to appear before the Court of First Instance Djoum to respond to charges of illegal killing of protected animal species. That in the month of November 1991, he killed a chimpanzee in an area prohibited from hunting. During the trial, the court found that he had been prosecuted and sentenced for the same facts and offence following the court decision N°173/Cor of 09 June 1992. The copy of this judgement was presented before the court to which he was sentenced to pay 50,000XAF for fines and to pay 50,000 XAF for damages. As per the law, an accused cannot be tried and sentenced for the same facts and offence twice. At the end of the hearing, the matter was adjourned for hearing.
