The accused was arrested by elements of the forestry and wildlife control post in a vehicle. He was the driver of the said vehicle. The elements proceeded to search the vehicle while searching the vehicle he behaved suspicious. Based on this the elements proceeded to search goods. A parcel was uncovered containing 16 Ivory tusks.

Two French citizens, GARCIA Laurent Raymond Ferdinand and DELATOUCHE Jean Marc obtained a hunting permit to kill elephants in a hunting zone organized by a hunting SAFARI. They killed an elephant, took out valuable trophies and abandoned the elephant carcass for the indigenous people.

The accused persons, Aye Mondo & Melolodom Richard are Bakas, indigenous people. They were arrested by elements of the conservation service after killing an elephant, and were found in possession of the ivories. They were forwarded before the court of First Instance, Abong Mbang for Prosecution.

In 2015, the accused NGONGHO Francis SENGHO was arrested flagrante delicto by elements of the conservation service of the Divisional Delegation of Forestry and Wildlife, Batouri. He was found in possession of trophies of totally protected animal species (Gorilla and Chimpanzees).

In 2012, the accused MOHAMADOU BELO was arrested flagrante delicto by elements of the conservation service with smoked four yellow duiker legs, 4 bush pig legs, 13 smoked black duiker legs, 12 smoked Monkeys, 40 smoked Blue Duikers, 12 Brush-tailed porcupine, and 01 smoked African Palm Civet.

In 2015, the accused persons, BOUSSE AKOUYA David, NAMOUDJOU Hughes, NGOMBE Freddy, ANKOAT Clovis & MIKOUAKOU Aubin Lebrun were arrested by elements of the conservation service of the Lobeke National Park.

The accused, Feussi Andre was arrested for the illegal killing of totally protected species (Giant pangolins). On this ground, he was prosecuted before the Court of First Instance Abong Mbang.

The facts are that the the appellant owned a safari lodge on a piece of land within a nature reserve. His main tourist attraction was the wildlife on the nature reserve. However poaching on the reserve had led to the reduction in wildlife sightings and therefore lower volumes of business.

The accused pleaded guilty and were convicted for unlawfully hunting 2 rhino’s and being in possession of rhino horns. The court below considered the seriousness of the crime and the number of rhino’s killed per year and the impact that poaching has on the economy and imposed a sentence of 6 years imprisonment and a N$60 000.00 fine.

The accused entered onto the complainant’s farm in order to hunt an oryx and was charged with the offence of unlawful hunting of huntable game, and trespassing. The accused pleaded guilty to both counts and were accordingly convicted. The question arose whether there was a duplication of convictions when the court convicted on both counts.
